APPSALT SDK TERMS OF SERVICE

 

These Appsalt SDK Terms of Service (“Terms”) govern your enabling and use of Appsalt SDK on a third party application hosting Appsalt SDK (“Host Application”). By enabling Appsalt SDK on Host Application, you (“User” or “you”) agree to enter into a legally binding agreement with Appsalt.com (“Appsalt”, “we” or “us”‘) and agree to install Appsalt SDK on your device. 

By enabling Appsalt SDK on a Host Application, you also confirm that you have read and agree to be legally bound by our Privacy Policy

If you do not agree with the Terms or our Privacy Policy and do not want it to apply to you – you should refrain from enabling Appsalt SDK on your device.

You may not enable Appsalt SDK and accept the Terms if a) you are not of legal age in your country b) you are prohibited from enabling Appsalt SDK under applicable laws, c) You are prohibited from entering into agreements similar to these Terms pursuant to you existing legal obligations with your internet service provider, mobile service provider, etc, d) You are enabling Appsalt SDK for competitive purposes (e.g., monitoring availability, performance, or functionality).

Appsalt SDK

By installing the Appsalt SDK, you become part of Appsalt’s user network and agree to share your internet traffic with Appsalt and its clients. These clients remain anonymous to you, just as you remain anonymous to them. Your shared traffic may be used by various businesses for purposes such as verifying advertisements (potentially leading to seeing specific ads), gathering web data (possibly resulting in more captchas), or even accessing or providing streaming services. If you use a streaming platform and a client uses your device to access it, there’s a small chance you might temporarily lose access.

While Appsalt tries to prevent negative impacts to you, you are responsible for your ability to share your internet and for complying with local laws and agreements with other parties. Furthermore, installing the Appsalt SDK and agreeing to the Terms means you understand and accept these potential uses of your shared traffic. 

Appsalt reserves the right to change, temporarily stop, or permanently end the Appsalt SDK or any connected service at any time, with or without notice and without any liability.

Compatibility with Internet Provider Services

Your use of the Appsalt SDK may be charged by some internet providers for data and related services. Appsalt will not be responsible for any traffic-related or other costs from your service providers due to your agreements with them. Your provider might also restrict or ban apps similar to Appsalt SDK, and it may not be compatible with all their rules, so you should confirm its usability with them before enabling Appsalt SDK.

Termination and Modification

We may terminate these Terms or your use of Appsalt SDK at any time for any reason, including but not limited to actual or alleged violations of these Terms. Appsalt shall not be liable to you or any third-party for any termination of your access to Appsalt SDK.

You may terminate these Terms by deleting the Host Application and all copies thereof from your device.

We reserve the right to modify, suspend or discontinue Appsalt SDK with or without notice and without liability to you.

Limitation of Liability 

UNDER NO CIRCUMSTANCES WILL EITHER PARTY BE HELD LIABLE TO THE OTHER OR ANY THIRD PARTY FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES, REGARDLESS OF THE CAUSE OR THE LEGAL BASIS FOR THE CLAIM (INCLUDING NEGLIGENCE). THIS LIMITATION APPLIES EVEN IF A LIMITED REMEDY FAILS TO ACHIEVE ITS MAIN PURPOSE. APPSALT’S OVERALL LIABILITY ARISING FROM OR RELATED TO THESE TERMS SHALL BE CAPPED AT $200 OR THE MAXIMUM EXTENT PERMITTED BY THE RELEVANT LAWS.

Other Provisions

If any part of these Terms is deemed unenforceable or invalid, it will be modified to achieve its purpose as much as legally possible, while the rest of these Terms remain in effect.

We can update these Terms by posting the new version on our website and informing you. These updates will be effective 14 days after the notice. If you disagree with any changes, your option is to stop using the Appsalt SDK by disabling it in the Host Application and deleting the Host Application from your device. Continuing to use the Host Application with the Appsalt SDK enabled after this 14-day period means you accept the updated Terms.

If we don’t act on a right or part of these Terms, it doesn’t mean we waive the right to do so at any other point. If any part of these Terms is found to be illegal, void, or unenforceable, that part will be removed without impacting the rest of the Terms. 

You are not allowed to resell, assign, or transfer your rights under these Terms. Attempting to do so may lead to termination without any obligation on our part. However, we can assign these Terms to a related company at any time with reasonable prior notice.
